A draft copy of the US Congressional bill, the Digital Goods Consumer Protection Act (DCCPA), has been uploaded to GitHub by crypto attorney Gabriel Shapiro.
Opinions are divided on the potential impact of Decentralized Finance (DeFi).
The latest draft appears to buffer a language perceived as detrimental to DeFi, a category of blockchain-based solutions aimed at improving finance by replacing central intermediaries with software code.
Describes digital goods, brokers, custodians, dealers and the elements that make up the platform.
This document also contains the rules and core principles that apply to players in the realm of digital goods.
Shapiro noted that the draft excludes those who develop or publish software from the term “digital goods trading facility.”
He said it could help the crypto industry by protecting software engineers.
However, he expressed doubts about the origins of this exclusion and urged other commentators to review the draft and comment.
Delphi Labs’ legal counsel said the draft was shared for “transparency and open discussion on the future of cryptocurrencies.”
The bipartisan bill was introduced in August by Senators Debbie Stabenow (D-MI) and John Boozman (R-AR).
Their legislation states that Bitcoin and Ether must be classified as commodities, as opposed to securities that fall under the jurisdiction of the Securities and Exchange Commission (SEC).
This means that the Commodity Futures Trading Commission (CFTC) will have exclusive jurisdiction over it.
According to the Washington Post after the bill was introduced, Buzman said in a press call that the cryptocurrency industry “almost universally” prefers to be regulated by the CFTC.
Sam Bankman-Fried Believes Draft Bill Won’t Kill DeFi
FTX CEO Sam Bankman-Fried is delighted to see โstrong legislationโ addressing customer protection in cryptocurrencies and has expressed his support for the framework.
On Wednesday, the cryptocurrency billionaire tweeted that the Stavenow-Buzman Act would not jeopardize the “existence of software, blockchain, validators, DeFi, etc.”
He also shared his thoughts on what crypto regulations should look like on his blog, especially saying it’s important to “keep on-chaincode and DeFi free, open and uncensored.”
Nevertheless, Bankman-Fried, head of centralized cryptocurrency exchanges, has been criticized for supporting legislation that appears to threaten decentralized protocols.
Concerns about Congress stifling decentralization
On an important aspect of the debate, the Web3 startup accelerator Alliance DAO denigrated the DCCPA Act as forcing human intervention and forcing projects to sacrifice decentralization.
The DAO believes that the legislation does not clarify what a digital commodity is, or clearly distinguish between a token that is a commodity and a token that is not.
Framework Ventures co-founder Vance Spencer also voiced objection, saying the venture capital firm is “against DCCPA and the shadow cliques trying to make it a reality.”
