Prospects for Victory in Litigation with Ripple SEC – Crypto Law Experts
According to legal experts, U.S.-based blockchain company Ripple Labs predicted that it would eventually win a legal dispute with the U.S. Securities and Exchange Commission (SEC).
The SEC’s lawsuit against Ripple is expected to have a major impact on the cryptocurrency and blockchain community and is widely expected around the world.
Ripple’s recent accumulation of XRP whales is analyzed in anticipation of possible litigation resolution.
Legal experts say Ripple is on track to win the case.
Ripple has been in a legal battle with the SEC for nearly two years.
Predictions and expectations about the future of XRP have come into the limelight as this could also affect the crypto industry.
Some legal observers said Ripple is getting closer to victory.
Federalist Society legal expert Curt Levey and George Mason University’s Scalia School of Law professor JW Verret each believe Ripple will win the case.
According to Verret, if the SEC decides to appeal to the Supreme Court, it is more likely to lose, setting a precedent for completely limiting or eliminating Howey’s application to cryptocurrencies.
The Howey test is used to determine whether a particular transaction is an “investment contract” and is therefore subject to U.S. securities laws.
Another prominent legal expert, Attorney Jeremy Hogan, said the SEC won’t be able to prove a case against the company unless Judge Torres, who is in charge of the case, forgets his freshman year of law school.
Potential Loss of the SEC
As Forbes reports, this verdict could significantly limit the SEC’s authority to regulate cryptocurrencies, which would be a self-inflicted disaster in the first place.
In December 2020, the SEC sued Ripple and two executives of the company for violating securities laws and classifying the XRP token sale as unregistered securities.
Ripple argued that there was no legal basis for requiring the SEC to register XRP as a security.
Additionally, more than 75,000 XRP investors have joined in submitting an Amicus brief to support Ripple.
As the latest case proceeded in early October, the SEC was forced to turn over Bill Hinman documents.
According to related documents, Ethereum (ETH) is not a security because the ledger has been โdecentralizedโ over time. As a result, Ripple is taking a similar position as it is highly relevant to this case.
Ripple’s win could not only boost the price of the token, it could also set a precedent for preventing the SEC from classifying cryptocurrencies as securities.
